Napster Involved In Another Lawsuit… When Will It End?

Yes, it’s that time of the month again. Once again, Napster is in the middle of a lawsuit. Does this surprise anyone? The company has been sued almost continuously since it was initially shut down in 2001. This time the suing is being done by the Universal Music Group (UMG) who is suing Bertelsmann AG because of its relationship with the service. UMG reportedly filed suit on May 12 in the U.S. District Court for the Southern District of New York.

Universal is contending that Bertelsmann sent millions of dollars in the direction of the file sharing service, which, in Universal’s opinion harmed record companies. Basically, Bertelsmann is being tagged as the invisible hand that ran Napster. Universal claims that the company facilitated the piracy of the music on a large scale.

UMG does not name an exact dollar figure, but they are seeking $150,000 for each copyrighted song that was stolen. Seeing as they represent artists like Shania Twain and Limp Bizkit, that could add up to a lot of coin. In fact, they feel as though Bertelsmann helped in contributing to, "millions upon millions of illegal acts of copyright infringement."

This lawsuit is one of many that has recently been launched against the now shut down service. We reported a few weeks ago that Universal Music and EMI music were suing Hummer Winbald Venture Partners, as well as Hank Barry and John Hummer, two of the firm’s general partners in San Francisco, again for copyright violations because they helped bankroll Napster.

What does this all mean? With the nails having been pounded into Napster’s coffin ages ago, the lawsuits seem like little more than a message that the record companies are sending out to Napster copy-cats: Don’t mess with us. Will big business beat out the legions of computer nerds looking for a free way to get music to the masses? Stay tuned…
